What is the functional Will Structure for Married Couple with Minor Children?<\/u><\/strong><\/p>\n

For a non-Muslim married couple with minor children in Peninsular Malaysia<\/strong>, the most suitable arrangement is usually:<\/p>\n

Two separate but coordinated Functional Wills, each containing a Testamentary Trust for the minor children.<\/strong><\/p>\n

Each spouse should sign an individual Will. The two Wills may contain similar or \u201cmirror\u201d provisions, but they remain separate documents that either spouse can later amend.<\/p>\n

Recommended structure<\/strong><\/p>\n

    \n
  1. Primary provision for the surviving spouse<\/strong>
    \nEach spouse may give the estate to the surviving spouse, provided the spouse survives for a stated period, commonly 30 days.<\/li>\n
  2. Testamentary trust for the children<\/strong>
    \nIf the spouse has already died, or both parents die together, the estate should not be distributed directly to the minor children. Instead, it should be held by the trustee for purposes such as:<\/p>\n
      \n
    • maintenance and daily living expenses;<\/li>\n
    • education, including university and vocational training;<\/li>\n
    • medical and healthcare expenses;<\/li>\n
    • accommodation and other welfare needs; and<\/li>\n
    • emergency or special expenses.<\/li>\n<\/ul>\n<\/li>\n
    • Delayed or staged distribution<\/strong>
      \nInstead of giving each child the entire inheritance immediately upon reaching adulthood, the Will may provide:<\/p>\n
        \n
      • part at age 25; and<\/li>\n
      • the balance at age 30;<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n

        or allow the trustee to retain the inheritance until an appropriate age. This provides better protection against immaturity, poor financial decisions and outside influence.<\/p>\n

        1. Guardian and substitute guardian<\/strong>
          \nBoth parents should appoint the same preferred guardian and at least one substitute guardian. Under section 7 of the Guardianship of Infants Act 1961, a parent may appoint a guardian by Will. However, the surviving parent generally remains a guardian, and the appointed guardian may act jointly with the surviving parent depending on the circumstances.<\/li>\n
        2. Executor and trustee<\/strong>
          \nThe surviving spouse may be appointed as the first executor. A reliable substitute executor and trustee should also be appointed. Where the trust may continue for many years, a trust corporation<\/strong> can provide continuity, professional administration and independence.<\/li>\n
        3. Common-disaster provision<\/strong>
          \nThe Wills should state what happens if both spouses die together or it cannot be established who died first.<\/li>\n
        4. Replacement beneficiaries<\/strong>
          \nThe Will should address what happens if a child dies before receiving the full inheritance\u2014for example, whether that child\u2019s entitlement passes to their own children or to the surviving siblings.<\/li>\n<\/ol>\n

          Typical distribution plan<\/strong><\/p>\n

          A practical arrangement would be:<\/p>\n

          If my spouse survives me by 30 days, my residuary estate shall be given to my spouse. If my spouse does not survive me by 30 days, my residuary estate shall be held upon trust for my children in equal shares, with power for my Trustee to use the income and capital for their maintenance, education, medical expenses and advancement until they attain the specified distribution age.<\/strong><\/p>\n

          For stronger protection\u2014particularly where remarriage, a blended family or financial vulnerability is a concern\u2014the first spouse\u2019s estate can instead be placed into a spouse-and-children testamentary trust<\/strong>. The surviving spouse may receive income, maintenance and a right to occupy the family home, while the underlying capital is preserved ultimately for the children.<\/p>\n

          A parent\u2019s Will is particularly important where children are minors because it can identify the preferred guardian and establish a trust fund rather than leaving the children\u2019s inheritance without detailed management instructions.<\/p>\n

          Therefore, a simple direct-distribution Will is normally insufficient<\/strong>. The better solution is a Functional Will with guardianship provisions and a properly drafted Testamentary Trust<\/strong>. Different succession rules apply to Muslims and potentially to residents or assets governed by Sabah or Sarawak law, so the documents should be prepared according to the family\u2019s religion, domicile and location of assets<\/p>\n
