Suitable Will structure for a single parent with minor children<\/u><\/strong><\/p>\n

For a non-Muslim single parent in Malaysia<\/strong>, the most suitable arrangement is generally a Functional Will incorporating a Testamentary Trust<\/strong>, rather than giving the estate directly to the children.<\/p>\n

1. Appoint an executor and trustee<\/strong><\/p>\n

Appoint a reliable person or preferably a trust corporation<\/strong> to:<\/p>\n

    \n
  • administer the estate;<\/li>\n
  • settle debts, taxes and expenses;<\/li>\n
  • manage money and property for the children;<\/li>\n
  • pay for their maintenance, education and medical needs; and<\/li>\n
  • distribute the balance when they reach the chosen age.<\/li>\n<\/ul>\n

    It is often safer to appoint the executor and trustee separately from the guardian<\/strong>. The guardian cares for the children, while the trustee controls and accounts for the assets.<\/p>\n

    2. Appoint a guardian and substitute guardian<\/strong><\/p>\n

    Name:<\/p>\n

      \n
    • a primary guardian; and<\/li>\n
    • at least one substitute guardian.<\/li>\n<\/ul>\n

      Under section 7 of Malaysia\u2019s Guardianship of Infants Act 1961, a parent may appoint a guardian by Will. However, where another surviving legal parent remains, the appointed guardian may have to act jointly with that parent, and disputes may ultimately be determined by the court according to the child\u2019s welfare.<\/p>\n

      Therefore, the Will should not merely say, \u201cI give custody to my sister.\u201d It should properly appoint the person as testamentary guardian<\/strong> and state the parent\u2019s reasons and wishes concerning the children\u2019s care.<\/p>\n

      3. Place the children\u2019s inheritance in a testamentary trust<\/strong><\/p>\n

      A suitable structure would be:<\/p>\n

      My Trustee shall hold my residuary estate upon trust for my children in equal shares until each child attains the age of 25 years.<\/p>\n

      The age could be 21, 25 or 30<\/strong>, depending on the parent\u2019s preference. Many parents choose 25 because an 18- or 21-year-old may not yet be ready to manage a large inheritance.<\/p>\n

      A testamentary trust is commonly used in Malaysia to protect inheritances for minor children rather than distributing assets outright.<\/p>\n

      4. Give the trustee flexible payment powers<\/strong><\/p>\n

      Before final distribution, authorize the trustee to use income and capital for each child\u2019s:<\/p>\n

        \n
      • food, clothing and accommodation;<\/li>\n
      • school and university fees;<\/li>\n
      • medical and dental expenses;<\/li>\n
      • insurance;<\/li>\n
      • extracurricular and enrichment programmes;<\/li>\n
      • vocational or professional training;<\/li>\n
      • special needs; and<\/li>\n
      • general welfare and advancement.<\/li>\n<\/ul>\n

        The Will may also permit the trustee to pay money directly to schools, hospitals, landlords or the guardian instead of handing unrestricted cash to the guardian.<\/p>\n

        5. Provide for the family home<\/strong><\/p>\n

        The Will should specifically address the home. Possible arrangements include:<\/p>\n

          \n
        • allow the guardian and children to stay in the home rent-free;<\/li>\n
        • retain the home until the youngest child reaches a stated age;<\/li>\n
        • authorize the trustee to pay mortgage instalments, quit rent, assessment, insurance and repairs;<\/li>\n
        • permit the trustee to sell the home if retention becomes impractical; and<\/li>\n
        • use the sale proceeds to buy or rent another suitable residence for the children.<\/li>\n<\/ul>\n

          This prevents the executor from being forced to sell the home immediately merely to distribute the estate.<\/p>\n

          6. Separate guardianship expenses from inheritance<\/strong><\/p>\n

          Provide a reasonable allowance to the guardian for:<\/p>\n

            \n
          • the children\u2019s living expenses;<\/li>\n
          • additional household costs;<\/li>\n
          • transport;<\/li>\n
          • domestic assistance; and<\/li>\n
          • other expenses incurred in caring for the children.<\/li>\n<\/ul>\n

            The trustee should have discretion to review the allowance periodically. The guardian should not automatically receive ownership of the children\u2019s inheritance.<\/p>\n

            7. Include replacement provisions<\/strong><\/p>\n

            The Will should state what happens when:<\/p>\n

              \n
            • the guardian dies, refuses or becomes unsuitable;<\/li>\n
            • the trustee cannot continue;<\/li>\n
            • one child dies before receiving the full inheritance;<\/li>\n
            • all children die before the trust ends; or<\/li>\n
            • the parent and children die in the same accident.<\/li>\n<\/ul>\n

              For example, a deceased child\u2019s share may pass to that child\u2019s descendants, failing which to the surviving siblings.<\/p>\n

              8. Include a complete residuary estate clause<\/strong><\/p>\n

              The trust should cover the entire residuary estate, including:<\/p>\n

                \n
              • bank accounts;<\/li>\n
              • investments;<\/li>\n
              • properties;<\/li>\n
              • shares;<\/li>\n
              • vehicles;<\/li>\n
              • insurance proceeds payable to the estate;<\/li>\n
              • digital assets;<\/li>\n
              • refunds and compensation; and<\/li>\n
              • assets acquired after signing the Will.<\/li>\n<\/ul>\n

                Without a proper residuary clause, some assets may fall into intestacy. Malaysia\u2019s Distribution Act governs applicable non-Muslim estates where property is not effectively disposed of by Will.<\/p>\n

                Recommended structure<\/strong><\/p>\n

                Executor:<\/strong> Trust corporation or suitable responsible person
                \nTrustee:<\/strong> Preferably a trust corporation, with a replacement trustee
                \nGuardian:<\/strong> Trusted family member or friend
                \nSubstitute guardian:<\/strong> At least one
                \nBeneficiaries:<\/strong> Minor children in equal or specified shares
                \nTrust period:<\/strong> Until each child reaches 25 or another chosen age
                \nInterim payments:<\/strong> Education, maintenance, medical care and advancement
                \nHome arrangement:<\/strong> Right of occupation or retention for the children
                \nFinal distribution:<\/strong> Staggered or full distribution at the selected age
                \nBackup beneficiaries:<\/strong> Named persons or charities if no child or descendant survives<\/p>\n

                A Will alone may also be insufficient for immediate needs<\/strong>, because estate administration takes time. The parent should consider coordinating the Will with insurance, nominations, an emergency fund and possibly a living or insurance trust so money is available promptly after death.<\/p>\n

                This structure primarily concerns non-Muslims in Peninsular Malaysia<\/strong>.
