The money could be spent too quickly, invested poorly or influenced by other people.<\/p>\n<ol start=\"2\">\n<li><strong> It does not provide long-term money management<\/strong><\/li>\n<\/ol>\n<p>A nomination normally cannot set out a complete payment plan such as:<\/p>\n<ul>\n<li>monthly maintenance for the family;<\/li>\n<li>education expenses for children;<\/li>\n<li>medical and caregiving expenses;<\/li>\n<li>payment at different ages;<\/li>\n<li>preservation of capital for future needs.<\/li>\n<\/ul>\n<ol start=\"3\">\n<li><strong> Minor beneficiaries cannot practically manage the proceeds<\/strong><\/li>\n<\/ol>\n<p>Where the intended beneficiary is a young child, another person may have to receive or administer the money. A nomination alone may not provide the detailed safeguards, professional management and distribution rules that the parent intended.<\/p>\n<ol start=\"4\">\n<li><strong> It may not adequately protect vulnerable beneficiaries<\/strong><\/li>\n<\/ol>\n<p>A beneficiary with special needs, financial difficulties, addiction issues or poor money-management ability may require controlled and continuing support rather than an unrestricted lump-sum payment.<\/p>\n<ol start=\"5\">\n<li><strong> It does not address replacement beneficiaries comprehensively<\/strong><\/li>\n<\/ol>\n<p>The policy owner should consider what happens when:<\/p>\n<ul>\n<li>the nominee dies before the policy owner;<\/li>\n<li>the nominee dies shortly after receiving the proceeds;<\/li>\n<li>the nominee loses mental capacity;<\/li>\n<li>family circumstances change;<\/li>\n<li>a marriage ends.<\/li>\n<\/ul>\n<p>A properly drafted trust can include alternative beneficiaries and detailed contingency provisions.<\/p>\n<ol start=\"6\">\n<li><strong> It does not coordinate all family objectives<\/strong><\/li>\n<\/ol>\n<p>Insurance proceeds may need to be coordinated with the Will, existing assets, debts, children\u2019s education, support for elderly parents and business-succession arrangements. A nomination deals only with the relevant policy proceeds.<\/p>\n<p>Under Malaysia\u2019s Financial Services Act 2013, the legal effect of a nomination depends partly on the relationship between the non-Muslim policy owner and the nominee. A nomination in favour of a spouse or child, or a parent where there is no spouse or child at the time of nomination, may create a statutory trust.
